These Terms & Conditions ("Terms") govern your use of the website operated by Austin Second Chance Apartments ("we", "us", "our") and the apartment locating services we provide. By using our website or services, you agree to these Terms.

Our Services

Austin Second Chance Apartments provides:

• Free Apartment Locating: Personalized property lists, real-time availability checks, accompanied tours, and neighborhood matching across the Greater Austin metro. 100% free to renters. We are paid a referral commission directly from property marketing budgets.
• Second Chance Apartment Locating: Specialized matching for renters with bad credit, broken leases, evictions, property debt, or background history. Same free model as standard locating.
• Private Home Rentals: MLS-based searches for privately owned houses, townhouses, and condos. Carries a flat $250 administrative fee for dedicated search, accompanied tours, and lease-negotiation representation through lease execution.

No Guarantee of Approval

Every property reviews applications case-by-case. We match you only to properties that have a history of approving similar situations, but final approval is at the discretion of each property owner or manager and depends on your full application, credit, rental history, income, background, and any other criteria the property uses. We do not guarantee approval at any specific property.

Application Fees

Application and administrative fees charged by properties are paid directly to those properties and are non-refundable, even if your application is denied. By design we pre-screen properties to minimize the risk of denial, but we cannot refund property-side fees.

Private Home Rentals Fee

If you engage our Private Home Rentals service, the $250 administrative fee is charged separately and covers the dedicated MLS search and representation. The fee is earned when the service begins.

Authorization to Submit Applications

By providing us with information needed for an application (income, ID, employment history, etc.), you authorize us to share that information with properties you specifically agree to apply to. We do not submit applications on your behalf without your consent.

Communication

When you contact us by phone, text, email, or web form, you agree we may respond using the same channel and provide updates on your search by text and email until you ask us to stop.

Fair Housing

We operate in compliance with the Fair Housing Act and Texas Real Estate Commission rules. We do not discriminate based on race, color, religion, national origin, sex, familial status, disability, or any other protected class.

Limitation of Liability

To the maximum extent permitted by law, our liability for any claim arising out of our services is limited to the fees you paid us (if any). For free services, our liability is limited to refunding any fees you paid to us directly, which for standard and second-chance locating is $0.

Intellectual Property

Content on this website is owned by Austin Second Chance Apartments or used with permission. You may not copy or republish content for commercial use without our written consent.

Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes will be handled in the state or federal courts located in Travis County, Texas.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the latest revision. Continued use of the site or services after an update means you accept the revised Terms.
